Terms of Service

1. Platform Overview

TimeFlys provides a digital platform that allows users to request, compare, and book private aircraft charter services from third-party operators (“Operators”). Please note:

• Aggregator Role: TimeFlys acts solely as an aggregator, connecting passengers with independent Operators who provide charter services. We do not own, operate, manage, or control any aircraft, nor do we employ any pilots, crew members, or staff associated with the charter services.
• No Direct Charter Services: TimeFlys does not itself offer charter flights, and we are not responsible for the operation, safety, or condition of the aircraft you book through our platform. All charters are provided by Operators, and all arrangements are directly between you and the Operator.

2. User Responsibilities

• Accuracy of Information: You agree to provide accurate and complete information when using the TimeFlys platform and requesting charter services.
• Compliance with Laws: You are responsible for complying with all applicable federal, state, and international laws regarding your booking and use of charter flights. TimeFlys is not liable for your compliance with these laws.

3. Release of Liability

You acknowledge and agree to release, discharge, and hold TimeFlys, its affiliates, and its directors, officers, and employees harmless from any claims, demands, and damages of every kind and nature, known or unknown, arising out of or in any way connected with:

• Operation of Charter Flights: The performance, operation, or conduct of the Operator and any of its employees, contractors, or subcontractors.
• Delays, Cancellations, or Changes: Any delays, cancellations, or changes in service, as these are outside of TimeFlys’ control and are the sole responsibility of the Operator.
• Inherent Risks: The inherent risks involved with air travel and charter services, including personal injury, property damage, or other harm. TimeFlys disclaims any liability for these risks.

4. No Guarantee of Availability

TimeFlys does not guarantee the availability of any particular aircraft, route, or Operator on its platform. All bookings are subject to the Operator’s availability and approval.

5. Payment and Fees

• Fees and Charges: The price displayed on the TimeFlys platform is our estimate of what the selected Operator would typically charge for the requested route, including any applicable fees and taxes.
• Payment Processing: Payments for charter services are made directly to the Operator. TimeFlys is not responsible for payment issues between you and the Operator.

6. Cancellations and Refunds

• Operator’s Policy: Cancellations and refund policies are determined by each Operator and may vary. Please review the Operator’s policy before booking. TimeFlys is not responsible for cancellations or refunds.
• Service Fees Non-Refundable: The 5% service fee charged by TimeFlys is non-refundable, even in cases of cancellation.

7. Dispute Resolution

If you have a dispute with an Operator, you agree to address it directly with them. TimeFlys is not liable for any disagreements or conflicts arising from your arrangements with the Operator. In the event of a dispute between you and TimeFlys, the following steps apply:

• Informal Negotiation: You and TimeFlys agree to attempt an informal resolution by contacting TimeFlys at support@timeflys.co.
• Arbitration: If informal negotiation fails, the dispute will be resolved through binding arbitration in Indiana.

8. Prohibited Conduct

When using the TimeFlys platform, you agree not to:

• Misrepresent your identity or authority to book a charter flight.
• Use the platform for any unlawful or fraudulent purposes.
• Engage in any conduct that may disrupt or interfere with the platform’s operation.

9. Intellectual Property

All content, logos, graphics, and design elements on the TimeFlys platform are the property of TimeFlys. You are granted a limited, non-exclusive license to use the platform for its intended purpose.

10. Limitations of Liability

TimeFlys is not liable for:

• Damages: Any indirect, incidental, or consequential damages arising from your use of the platform.
• Service Interruptions: Any delays, interruptions, or technical issues with the platform or its services.
• Accuracy of Information: TimeFlys does not guarantee the accuracy of information provided by Operators or other third parties. We are not responsible for the Operator’s adherence to regulatory or safety standards.

11. Changes to Terms

TimeFlys reserves the right to modify or update these Terms at any time. Changes will be effective immediately upon posting. By continuing to use the platform after any changes, you agree to be bound by the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Indiana.

13. Booking Requests and Operator Confirmation

• Booking Requests Only: By submitting a booking request through TimeFlys, you acknowledge that you are not directly booking an aircraft. Instead, you are making a request to book a charter flight at the specified price and date based on the information provided at the time of your inquiry.
• Operator Contact and Confirmation: After your request is submitted, the selected Operator will contact you directly to confirm the details of your requested charter. This may include verifying flight details, availability, and potentially adjusting the quote to reflect final costs, including any additional fees or requirements.
• Final Booking and Payment with Operator: The finalization of your booking and any payments are arranged directly with the Operator. TimeFlys does not facilitate, collect, or hold payments for charter services. By proceeding with a booking request, you understand and agree that all booking terms and final confirmations are at the discretion of the Operator.

14. Estimated Pricing

• Quote Estimates: The price provided at the time of your booking request on TimeFlys is an estimated quote based on what the selected Operator would typically charge for the requested charter. This estimate is intended to provide you with an approximate cost and is not a guaranteed price.
• Final Pricing Confirmation: Final pricing is subject to confirmation by the Operator and may vary based on factors such as flight specifics, scheduling adjustments, and additional fees or surcharges that may apply. By submitting a booking request, you acknowledge that the final price may differ from the initial estimate displayed on TimeFlys.
